Terms of Service

Short version: Capture is a small Mac app made by an independent developer. You pay once for a license, install it on your Macs, and use it. Don't redistribute it, don't try to crack it, and don't blame us if you lose data — back up your Obsidian vault. If you're unhappy in the first 14 days, ask for a refund and you'll get one.

Who you're agreeing with

These terms are an agreement between you and Hiroic Ventures, a company organized in Texas, USA. In this document, "we", "us", and "our" mean Hiroic Ventures. "Capture" or "the App" means the Capture macOS application and its supporting website at capture.surf.

Your license to use Capture

When you purchase Capture, we grant you a personal, non-exclusive, non-transferable license to install and use the App on Macs you own or primarily use. You may activate the App on up to five Macs. If you need more activations (work Mac, home Mac, laptop, etc.), email us and we'll work it out.

The App, its source code, designs, branding, and all related materials remain the intellectual property of Hiroic Ventures. Buying a license gives you the right to use the App, not to own it.

Free trial

Capture offers a 7-day free trial that begins the first time you launch the App. During the trial you have full access to all features. When the trial ends, capture functionality is disabled until you purchase and activate a license. Your settings, captured notes, and Obsidian vault remain untouched — they're your files.

You may use the trial only once per Mac. Resetting the trial by reinstalling the App or clearing app data is a violation of these terms.

Purchase and pricing

The current price is listed on capture.surf. Payment is processed by our merchant of record, Polar, who handles the transaction, applicable taxes, and your receipt. Polar's terms and privacy policy apply to the payment portion of your transaction.

Prices are in US dollars unless your local checkout shows otherwise. We may change pricing for new purchases at any time, but a license you've already bought stays valid at the price you paid.

Refunds

We offer a 14-day, no-questions-asked refund. See our Refund Policy for details on how to request one.

Updates

Your license includes lifetime updates: every future version of Capture, free, in your existing license. No upgrade fees, no second purchases, no "Pro" tier appearing later. The current set of planned features lives on our public roadmap; that page describes what's likely, not a contractual list — but the lifetime-updates promise itself is unconditional.

Updates are delivered through Sparkle, the standard macOS update framework. We may stop supporting older versions of macOS over time; if your Mac can no longer run the latest version, you can keep using the version you have.

Your data and your responsibility to back up

Capture writes plain markdown files into your Obsidian vault on your disk. We do not store, sync, or back up those files for you. You are responsible for backing up your vault. A failed write, a renamed folder, an accidental overwrite, or a disk failure can result in lost data — that risk lives on your side, not ours.

How we handle the small amount of data we do see (anonymous analytics, license validation) is described in our Privacy Policy.

License key validation

Capture periodically checks with Polar to confirm your license is still valid. If you go offline, the App keeps working using a cached validation for up to 30 days. After 30 days without a successful re-validation, capture is paused until we can reach Polar again — your settings, notes, and Obsidian vault stay completely untouched. If a license is refunded, charged back, or revoked for violation of these terms, it can be deactivated remotely.

Acceptable use

You agree not to use Capture to do anything illegal, anything that violates someone else's rights, or anything that could harm the App or other users. You're responsible for what you capture, save, and store in your own Obsidian vault.

Third-party software

Capture works alongside Obsidian, an independent application made by Obsidian.md. We are not affiliated with, endorsed by, or sponsored by Obsidian or its makers. "Obsidian" is a trademark of its respective owner. Capture also bundles open-source components (Sparkle, KeyboardShortcuts, TelemetryDeck), each governed by its own license — full attribution is available in the App's About screen.

Warranty disclaimer

Capture is provided "as is" and "as available", without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't promise the App will be error-free, will work with every Obsidian configuration, will work on every macOS version, or will be available without interruption.

Limitation of liability

To the maximum extent permitted by law, Hiroic Ventures will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost data, lost profits, or lost notes — arising from your use of or inability to use the App. Our total liability for any claim related to the App is limited to the amount you paid for your license in the 12 months before the claim arose.

Termination

You may stop using Capture and uninstall it at any time. We may suspend or terminate your license if you violate these terms (for example, by sharing a license key publicly or trying to crack the App). If we terminate your license for cause, no refund is owed.

Changes to these terms

We may update these terms from time to time. Material changes will be posted on this page with a new "last updated" date. If you continue to use the App after changes are posted, you accept the new terms. For changes that materially affect your existing license, we'll do our best to notify you by email if you opted in to our list, or via an in-app notice.

Governing law and disputes

These terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law principles. Any dispute arising from these terms or your use of the App will be resolved in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of those courts. If you're a consumer in a jurisdiction (such as the EU or UK) whose laws give you protections that override this clause, those protections still apply to you.

Miscellaneous

If any part of these terms is found unenforceable, the rest still applies. Our failure to enforce a right under these terms doesn't waive that right. You may not assign or transfer your license without our written consent; we may assign these terms in connection with a merger, acquisition, or sale of assets.
